Media & Social Reuse Release

1. Status of this release

DRAFT FOR LEGAL REVIEW — NOT YET EFFECTIVE. This release is published so members, parents and studios can read it before it can be granted. It has not been reviewed or approved by an attorney and no consent is being collected under it yet.

When it is activated, granting or revoking it is recorded with the document version, content hash, timestamp and the account (or guardian) that acted.

2. You keep ownership

You continue to own your choreography, video, audio, photos and other content. This release does not transfer ownership or copyright and does not make POIZ the owner of your name, voice or likeness.

3. Ordinary upload is not promotional consent

Uploading or posting on POIZ grants only the operational license described in the Terms of Service: hosting, storage, backup, transcoding, cover-frame generation, indexing, moderation, delivery and display of your content so the service can run and show it to the audiences you choose.

That operational license is not advertising or marketing consent. California Civil Code section 3344 requires prior consent for the commercial use of a person's name, voice, signature, photograph or likeness, and for a minor the prior consent of a parent or legal guardian. POIZ therefore treats promotional reuse as a separate, affirmative permission recorded under this release.

4. What you grant if you agree

After your consent is recorded, and only from that point forward, you grant POIZ a worldwide, non-exclusive, royalty-free permission to use the media you have uploaded or publicly posted on POIZ, together with your display name or handle, voice and likeness, for POIZ's own promotion. POIZ's vendors and service providers may process, host or distribute the material only on POIZ's behalf and under POIZ's instructions.

• POIZ-owned or POIZ-controlled websites and in-app promotional surfaces.
• Official POIZ social media accounts.
• POIZ newsletters and email.
• Showcases, sizzle reels, trailers and event or community highlight material.
• POIZ advertising and promotional materials for POIZ itself.

5. Reasonable technical and editorial edits

You agree POIZ may make ordinary technical and editorial edits so the material works on each surface: cropping, resizing, reformatting, trimming, captions and subtitles, cover frames, compilations with other material, aspect-ratio changes and accessibility formatting.

POIZ will not use an edit to create a materially deceptive or defamatory impression of you.

6. Limits on this release

This release is deliberately narrow. It does not authorize any of the following, each of which needs a separate, express written agreement.

• Selling, licensing or transferring your identity, name, voice or likeness to an unrelated third party for that third party's own promotion.
• Any statement or presentation implying that you endorse or sponsor a product, brand, service or organization when you have not agreed to it.
• Any AI-generated or digital replica of you, voice cloning, synthetic performance, or materially altered synthetic endorsement.
• Use of media you did not upload or publicly post on POIZ.

7. What you confirm about the media

You confirm you hold the rights and permissions needed for the media, including the music, the choreography, any logos or brands shown, the venue or location, and every person appearing in it. This release does not clear music, choreography or other intellectual property rights you do not own, and it does not give POIZ rights the uploader never had.

If other identifiable people appear, you are responsible for having the authority to upload them. For POIZ promotional reuse of those other people, POIZ still needs any consent the law requires from them, or from their parent or legal guardian if they are under 18.

8. Anyone under 18

A person under 18 cannot grant this release for themselves, and POIZ does not treat a minor's confirmation as consent. Normal guardian consent for a child's POIZ account is not a marketing or media release.

A parent or legal guardian must separately review this release, affirm it for that specific child and sign it electronically. The guardian confirms they are the parent or legal guardian and have the authority to consent on the child's behalf.

ACTIVATION REQUIREMENT — guardian-granted media release is not collectible yet. The guardian consent architecture must be extended to record a guardian media-release assent (identity, relationship, signature, document version and content hash) before any promotional use of a minor's likeness is permitted.

9. Changing your mind

You may revoke this release for the future at any time through your POIZ settings, or through the Support Center at /support. For a minor, the parent or legal guardian may revoke it.

Revocation is prospective. After POIZ verifies a revocation, POIZ stops making new promotional uses within a reasonable operational period. POIZ cannot recall or delete copies that were already lawfully distributed, cached by third parties, printed, syndicated, downloaded, re-shared by other people or included in campaign materials that were already completed or placed, and POIZ may keep records of the consent and revocation as required by law or for recordkeeping.

POIZ does not state a fixed number of days here; a counsel-approved operational timeframe must be published before this release is activated.

10. Release of claims, and what is preserved

To the fullest extent permitted by law, you release POIZ only from claims that arise solely from a use actually authorized by this release — specifically claims for right of publicity or misappropriation of name, voice or likeness, invasion of privacy, and any right to inspect or approve a specific finished use.

This release does NOT cover, and POIZ does not ask you to give up, claims for defamation, fraud, deceptive or materially misleading use, willful misconduct, any use outside the scope you authorized, or any right or claim that cannot be waived under applicable law. Nothing here limits statutory rights of a minor beyond what the law allows.
