1. Status of this waiver

DRAFT FOR LEGAL REVIEW — NOT YET EFFECTIVE. This waiver is published for review. It is not currently in force, no assent is being collected under it, and it does not currently gate or block anything in the product.

When it is activated, assent is recorded with the document version, content hash, the account, the timestamp and the specific affirmative action taken.

2. Who and what this covers

This waiver applies to any person who performs, practices, records, attempts or follows a dance, combo, challenge, competition attempt, training exercise, drill, routine, stretch, warm-up, conditioning session or other physical activity because of, or in connection with, content on POIZ.

It does not apply to simply browsing, watching or reading on POIZ.

3. Inherent and other risks

Dance and fitness activity has inherent risks that cannot be eliminated, and other risks that can arise from equipment, surroundings, other people or your own condition. Those risks include, without limitation:

  • Slips, trips, falls and collisions with people, walls, furniture or equipment.
  • Overexertion, dehydration, heat illness, fainting and exhaustion.
  • Muscle, tendon and ligament injury, sprains, strains and tears.
  • Fractures, dislocations and joint damage.
  • Head, neck, back and spinal injury, including concussion.
  • Aggravation of an existing medical condition or injury.
  • Cardiac and respiratory events.
  • Permanent disability and paralysis.
  • Property damage.
  • DEATH.

4. Participation is voluntary and self-directed

Nothing on POIZ requires you to attempt any movement. You choose whether an activity is appropriate for your body, your health, your skill level and your surroundings, and you may stop at any time.

You are responsible for a clear and safe space; a suitable floor or surface; appropriate footwear, clothing and equipment; warming up and cooling down; hydration; supervision or a spotter where appropriate; and following any medical limitation, restriction or advice that applies to you.

Stop immediately if you feel pain, dizziness, faintness, shortness of breath, chest discomfort or anything unsafe, and seek appropriate medical care. Consult a qualified professional before starting or changing physical activity.

5. What POIZ is not

POIZ is software and technology. POIZ is not your dance instructor, coach, studio, school, gym, medical provider, physical therapist, athletic trainer, venue, supervisor, spotter, chaperone, lifeguard, emergency service or insurer. POIZ is not present where you dance and does not inspect, approve or supervise your location, floor, equipment or the people around you.

Automated scores, ratings and feedback are produced by software from the video you submit. They are not medical clearance, physical-therapy advice, injury screening or a safety approval of your technique, and must not be relied on as any of those things.

Third-party studios, teachers, venues, competitions and events are responsible for their own premises, staff, supervision, insurance and safety practices.

6. Assumption of risk

Knowing the risks described above, including the risk of serious injury, permanent disability, paralysis and death, you voluntarily and knowingly assume the inherent risks of participating in physical activity in connection with POIZ, and you accept responsibility for the decision to participate.

7. Release and waiver by an adult participant

TO THE FULLEST EXTENT PERMITTED BY LAW, if you are 18 or older you release, waive and agree not to sue POIZ and its applicable affiliates, officers, directors, employees, contractors and service providers for claims, demands, losses, injuries, illness, disability, death or damage arising out of or connected with your participation in physical activity in connection with POIZ, or your reliance on POIZ physical-activity content, where those claims arise from the inherent risks described above or from ordinary negligence.

WHAT IS NOT RELEASED. This waiver does NOT release, limit or waive gross negligence, recklessness, willful misconduct, fraud or intentional misrepresentation, a violation of law, or any liability, claim or right that cannot lawfully be released. California Civil Code section 1668 and California case law make clear that a release cannot exempt a party from responsibility for fraud, willful injury or a violation of law, and a recreational release cannot waive gross negligence. Those carve-outs control over any other wording in this document.

If any part of this waiver is held unenforceable, the rest remains in effect and is applied to the maximum extent the law allows.

8. Causes outside POIZ's control

To the fullest extent permitted by law, POIZ is not responsible for injury, illness or damage caused by your own choices or technique; your medical condition, fitness level or physical limits; your space, floor, surface, lighting, footwear or equipment; other participants or bystanders; animals, children or objects in your space; or third-party studios, teachers, choreographers, venues, competitions, classes, auditions, rehearsals or off-platform meetings arranged between users.

9. Participants under 18

A person under 18 may not execute this waiver. A checkbox ticked by a minor is not treated as a legal waiver, and POIZ shows a parent or legal guardian approval required state instead.

A parent or legal guardian must review this document and, where legally permitted, electronically assent for that child. In doing so the guardian confirms they are the parent or legal guardian, that they have decided the activity is appropriate for the child, and that they are responsible for the child's supervision, space and equipment.

A guardian cannot waive a minor's rights beyond what applicable law allows. Nothing here purports to waive a claim of a minor that California or other applicable law does not permit to be waived, or to release gross negligence, recklessness, willful misconduct, fraud or a violation of law.

ACTIVATION REQUIREMENT — guardian assent to this waiver is not collectible yet. The guardian consent architecture must be extended to record a guardian activity-waiver assent before this waiver can be enforced against a minor's participation.

10. Emergencies

POIZ is not present where you dance and cannot provide, summon, supervise or guarantee emergency or medical care. If you or someone with you is injured or in danger, contact your local emergency services.
